RELEASE AND WAIVER OF LIABILITY
ATHLETICS AND INTRAMURAL EVENTS

will participate in one or more
intercollegiate, intramural, or other organized sports and athletic
programs and other Athletic and Intramural Events and activities at
or of the Carroll College (“Carroll”) or in which Carroll
employees, students, staff and others participate (“Athletic and
Intramural Events”) at my own risk and I assume all risks of harm,
damage, liability, injury and loss associated with, related to or
potentially arising from or related to such participation.
I understand that participating in any Athletic Event can be
a dangerous activity involving risk of injury and even death.
I am
responsible for the cost of any and all medical and health services
I may require as a result of participating in Athletic and
Intramural Events.
In
consideration of Carroll’s permitting me to try-out and to engage
in Athletic and Intramural Events, including but not limited to,
practicing, training, observing, traveling to or from, and competing
in such Athletic and Intramural Events, I fully and irrevocably
release, waive and discharge Carroll, its officers, agents and
employees from all liability to me, and to my representatives,
assigns and heirs for any and all loss, liability, damages or
expense whenever arising or discovered, and for any claim or demands
on account of or related to any injury to me, including my death,
and any damage to my property while I am participating in an
Athletic Event, including injury, loss or damages caused in whole or
in part by the negligence of Carroll or its officers, employees or
agents, or any violation of the Safe Place Statute under Section
101.11 of the Wisconsin Statutes, excepting only injury or death
caused by intentional or reckless acts of Carroll.
I will
indemnify, and at Carroll’s request, defend, and save harmless
Carroll and its officers, employees and agents for any loss, damages
or expenses incurred by reason of any third party claim for injury,
loss or damages to me which I have released, waived or discharged in
this Release.
In addition,
I assume all liability for, am responsible for, indemnify, and hold
harmless Carroll and its officers, employees and agents against any
loss, liability, damage, or expense arising from any actual or
claimed death or injury to any person or actual or claimed damage to
property, whether owned by me, Carroll or third parties, including
loss of use, that actually or allegedly results from my conduct, by
act or omission, relating to my participation in Athletic and
Intramural Events.
Furthermore,
I understand that Carroll disclaims responsibility for team or
student activity group members and others who travel to Athletic and
Intramural Events in vehicles not owned by Carroll.
I assume all risks of driving myself and/or others to any
Athletic and Intramural Events.
Similarly, I assume irrevocably all risks of driving, riding
with other team or club members, spectators, coaches or others to
such activities in vehicles not owned by Carroll, including
transport to hospitals or urgent care centers for the treatment of
any injury I may sustain.
Therefore, I
assume all liability for, am responsible for, indemnify, and hold
harmless Carroll and its officers, employees and agents against any
loss, liability, damage, or expense arising from any actual or
claimed death or injury to any person or actual or claimed damage to
property, whether owned by me, Carroll or third parties, including
loss of use, that actually or allegedly results from my
transportation to or from Athletic and Intramural Events in any
vehicle not owned by Carroll.
I understand
the risks and dangers involved in participating in Athletic and
Intramural Events, am physically capable of participating in
Athletic and Intramural Events and any related activities, and agree
not to participate in any activities that may, in my knowledge,
result in injury to myself or others.
This Release
shall be effective for all Athletic and Intramural Events in which I
participate during an academic year.
Expiration of this period does not affect or terminate the
waiver of liability and release and obligation to indemnify which
includes for injury, loss, liability or damages arising or
discovered during or subsequent to the expiration of the stated
period.
I HAVE READ THIS RELEASE AND AGREE TO
BE BOUND BY THIS RELEASE. I
UNDERSTAND THAT THIS RELEASE BARS ME AND MY HEIRS, ASSIGNS AND
REPRESENTATIVES FROM ANY RECOVERY FROM CARROLL, INCLUDING ITS
OFFICERS EMPLOYEES AND AGENTS, FOR INJURY, DEATH, LOSS OR DAMAGE TO
ME AND FOR DAMAGE AND LOSS OF PROPERTY THAT RESULTS FROM OR IS
RELATED TO MY PARTICIPATION IN OR TRANSPORTATION TO/FROM ATHLETIC
AND INTRAMURAL EVENTS, AS SET FORTH ABOVE.
I ALSO UNDERSTAND THAT THIS RELEASE RELEASES CARROLL, ITS
OFFICERS, EMPLOYEES AND AGENTS, FROM ANY LIABILITY FOR ANY INJURY,
DEATH, LOSS OR DAMAGE TO THIRD PARTIES RESULTING FROM OR RELATED TO
MY PARTICIPATION IN OR TRANSPORTING OF PERSONS TO/FROM ATHLETIC AND
INTRAMURAL EVENTS, AS SET FORTH ABOVE.
